1. Introduction & Acceptance
Welcome to Tinddey ("Platform," "we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of our digital ordering platform and services.
By using Tinddey, you agree to:
- Be at least 18 years old
- Accept these Terms and Privacy Policy
- Comply with all applicable laws
2. Our Role & Business Model
Important Clarification
Tinddey is a Technology Platform Provider, not a restaurant, food business operator, or food seller.
2.1 What We Provide:
Digital ordering software for restaurants
Online presence and marketing support
Order management system
2.2 What We Do NOT Do:
Prepare, cook, or sell food
Handle food payments between customers and restaurants
Employ delivery personnel
Control restaurant operations or food quality
Legal Position:
We provide technology services only. Each restaurant operates as an independent business.
3. Financial Terms & Service Fees
3.1 Service Fee Structure:
Restaurants pay a Platform Service Fee for technology access
Fee calculated based on order volume and services used
Typical fee range: 15-30% of order value
Invoiced and collected as per agreed payment schedule
3.2 Payment Flow:
Customers pay restaurants directly (cash/UPI/card)
Tinddey does NOT collect or process food payments
Service fees settled separately between Tinddey and restaurants
Delivery charges (if any) collected separately for logistics services
Tax Responsibility: Restaurants are responsible for their own GST compliance on food sales. Tinddey handles its own tax compliance for service fees.
4. Delivery Partners
Independent Contractor Status
Delivery partners are INDEPENDENT CONTRACTORS, not employees of Tinddey.
4.1 Independent Contractor Relationship:
Delivery partners operate their own independent delivery businesses
No employer-employee relationship with Tinddey
Delivery partners provide their own vehicles and equipment
Delivery partners are responsible for their own taxes, insurance, and licenses
4.2 Delivery Responsibility:
Restaurants are primarily responsible for order delivery completion
Tinddey provides technology to connect restaurants with delivery partners
Delivery quality and timeliness are the responsibility of the delivery partner and restaurant
No Liability: Tinddey is not liable for delivery partner actions, accidents, delays, or misconduct.
5. Restaurant Responsibilities
5.1 Legal Compliance:
Maintain valid FSSAI license (display on platform)
Comply with all food safety and hygiene regulations
Obtain all necessary business licenses and permits
Handle their own GST registration and compliance
5.2 Operational Responsibilities:
Prepare and package food orders properly
Ensure food quality and safety standards
Handle customer complaints and refunds
Manage delivery arrangements and coordination
5.3 Customer Service:
Provide accurate menu information
Disclose allergen information
Handle order cancellations and modifications
Resolve food quality complaints directly with customers
6. Liability Limitations
Important Limitations
Understanding these limitations is essential for all platform users.
6.1 Food-Related Liability:
NOT RESPONSIBLE for food quality, safety, or freshness
NOT RESPONSIBLE for food allergies or health effects
NOT RESPONSIBLE for incorrect orders or missing items
6.2 Delivery-Related Liability:
NOT RESPONSIBLE for delivery delays or failures
NOT RESPONSIBLE for delivery partner conduct or accidents
NOT RESPONSIBLE for lost or damaged orders during delivery
6.3 Financial Liability:
NOT RESPONSIBLE for payment disputes between customers and restaurants
NOT RESPONSIBLE for restaurant financial issues or closures
Maximum liability limited to service fees paid in last 30 days
Allergy Warning
Customers with food allergies must verify ingredients with restaurants directly.
Tinddey does not verify or guarantee allergen-free preparation.
7. Privacy & Data Protection
7.1 Data Collection:
Collect minimal data necessary for service provision
Data includes: name, contact, address, order history
Payment data processed securely through certified providers
7.2 Data Sharing:
Share order details with restaurants for preparation
Share delivery details with delivery partners for fulfillment
Do not sell personal data to third parties
Share aggregated, anonymized data for analytics
7.3 Your Rights (DPDP Act 2023):
Right to access your personal data
Right to correct inaccurate data
Right to delete your data
Right to grievance redressal
Data Protection
We implement reasonable security measures to protect your data.

8. General Terms
8.1 Service Area:
Currently serving Shahjahanpur, Uttar Pradesh only.
8.2 Modifications:
We may update these Terms periodically
Continued use after changes constitutes acceptance
Significant changes notified via email or platform notification
8.3 Termination:
We may suspend accounts for Terms violations
Users may delete accounts anytime
Service fees non-refundable upon termination
8.4 Governing Law:
Governed by laws of India
Jurisdiction in Shahjahanpur, Uttar Pradesh
Dispute resolution through arbitration
8.5 Force Majeure:
Not liable for delays or failures due to circumstances beyond our control including natural disasters, government actions, internet failures, or other force majeure events.
